Protect Your Driver’s License

You have 15 days to protect your driver’s license. In Texas, if you are arrested for Driving While Intoxicated (DWI), that DWI arrest creates two separate cases. The DWI arrest results in a criminal charge and it also initiates a civil proceeding against the arrested motorist’s driving privileges called an Administrative License Revocation (ALR).

For all DWI and DUI cases, a hearing on the whether your arrest was constitutional can be requested. However, this request can only be made within 15 days after your arrest. Because of that strict time period, it is important to get in touch with an experienced DWI lawyer quickly. If you fail to request an ALR hearing, your driving privileges will be suspended on the forty-first (41st) day after your arrest.

In addition to the obvious benefit of possibly avoiding a license suspension, ALR hearings can be beneficial in other ways. A transcript of the officer’s testimony may prove to be a valuable tool in your DWI defense. The arresting officer will be called upon to testify later in your DWI case and the officer’s testimony at the ALR hearing may be very different than what he tries to testify to at your DWI trial. If no suspension is imposed at the hearing, the Texas Department of Public Safety is obligated to return the Texas license to the person arrested. If a suspension is ordered either automatically or after hearing, a driver must submit a reinstatement fee of $125 to the department before the license will be reinstated.
